You are prohibited from engaging in any unlawful, harmful, or abusive behavior while using the App. Furthermore, you agree not to: a) Violate any applicable laws, regulations, or third-party rights; b) Impersonate any person or entity or provide false information; c) Interfere with or disrupt the functionality of the App; d) Collect or harvest any information from the App without proper authorization; e) Engage in any activity that could harm, disable, overburden, or impair the App's servers or networks; f) Attempt to gain unauthorized access to any portion of the App or any other systems or networks connected to the App.

  • 2.1Ownership The App and its content, including but not limited to text, graphics, images, logos, icons, audio clips, video clips, data compilations, and software, are owned by Health Sync or its licensors and are protected by intellectual property laws.
  • 2.2Limited License Subject to your compliance with these Terms, we grant you a limited, non- exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes. You may not modify, reproduce, distribute, create derivative works of, publicly display, or otherwise exploit any portion of the App without our prior written consent.

• 4Disclaimer of Warranties The App is provided on an "as-is" and "as available" basis without any warranties or representations, express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components. Your use of the App is at your sole risk.
• 5Limitation of Liability To the maximum extent permitted by applicable law, in no event shall Health Sync or its directors, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if we have been advised of the possibility of such damages.
• 6Indemnification You agree to indemnify and hold Health Sync and its directors, officers, employees, agents, and affiliates harmless from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the App or violation of these Terms.
• 7Modifications to the App and Terms We reserve the right to modify, suspend, or discontinue the App, or any portion thereof, at any time without prior notice. We may also revise these Terms from time to time by posting the updated version on the App. Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the changes.
• 8Governing Law and Jurisdiction These Terms shall be governed by and construed in accordance with the laws of New Jersey. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Jersey.
• 9Severability If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
• 10Entire Agreement These Terms constitute the entire agreement between you and Health Sync regarding the use of the App and supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and Health Sync regarding the subject matter herein.
